Hate has no logic except its power to destroy.

Hate has no reason except its delight in abuse.

Hate has no goodness in thought or in deed.

Hate is a damning influence and creed.

Hate is the one thing no one needs.

Some people hate? All people are garbage. Get rid of them all.

Hate until no one is left alive, no one at all.

NO KINGS DAY

The day begins with signs

Of all that any patriot finds

In need of expression

To resist oppression.

We line the streets

Feet deep

Only to meet

Aggression

From those who seek

Our suppression.

Gerrymandered districts

Are incomplete,

Unable to meet

Fair representation,

Denying the nation

one person one vote,

Intimidation afloat

In every state.

We pray it is not too late.

We pray our efforts matter.

We pray our mad-as-hatter

Administration

Stops destroying our beloved nation.

We sing. We dance. We shout.

This is what democracy is about.

No kings today.

No kings in any way.

No kings over courts’ justice.

No kings over any of us.

Every king eventually falls.

We do not want a king at all.

Weak Cores

Saving face

By creating truth

Is the only means of escape

From harsh reality

For those whose core

Is thinned and weak

By lack of moral exercise.

Bread and circuse

Did Rome in.

History ignored

Is repeated evermore.

Distraction through attraction

Diverts the gaze, the ear, the tongue.

This is who we live among.

Doing what is correct

Does not reflect the Right

Constantly claiming false

It’s moral might

Over those whose outrage

Threatens their control,

Their wealth, their privilege.

New faces in new places

Where they were not allowed before

Distort the world view

Of the autocratic few.

It takes strong core

Muscles to stand tall

Before the attack of falsehood

Destroys us all.

GRIEF LINES ABOUT THE BROW

GRIEF LINES ABOUT THE BROW

1-15-2022

I held grief at bay

in tightened fists

determined not to allow

its escape, until I lay

it down upon the page,

Where it sapped my strength.

Taking up the pen

is little help today

when the nib etches lines

of grief about my brow,

too close to allow the flow

of ink upon the page.

Democracy means more to those

More recently saved upon its shores.

The lands of autocrats and hypocrites,

we thought, had been left

behind, beyond our pained sight;

now resurrected by the Republican right.

A Right reinforced by clerics bent

on reasserting ties long rent

between church and state,

Now reinstated by the Court

and pro-life misogynist dictum

making women victims.

The Right backlash to Obama

is a fierce and hateful trauma

which dares to take away

our diversity and our vote,

our personhood and culture,

our history and democracy.

Grief is still heavy today

but less than yesterday.

Today ink flows steadily,

freely, hopefully daring leaders

to find the courage to save the vote,

and this beloved country.

Not My Job to Handle Your Feelings

Over 25 years ago our state bar association convened a group of women lawyers, 2 from each county, to address sexist laws and regulations, and court practices. I represented the county in which I practiced law. We met on Malcolm X’s birthday so I implored the group to also address racism as well. It seemed, I suggested, that only addressing sexism was insufficient to create justice. And as Malcolm said,” If you are not part of the solution, you are part of the problem”. The group agreed to expand its review and its reach.

The breakout sessions were useful. We formed sub-groups to research specific areas. At the close of the day the Chief Justice of our state Supreme Court, a man, and the president of the state bar association, a man, spoke to the group. They appeared a bit unsettled by our enthusiasm for the project. My comments citing Malcolm X contributed to their appearing to be ill at ease. One of the men advised us to ” go easy on the men” because our efforts and comments would ” hurt their feelings” and make them uncomfortable. They told us we need to “help them with their feelings” as we discussed and delivered our findings. It might be too upsetting for them.

That did it! I rose up out of my seat and announced that as women, and as African-Americans the lawyers in the room already had to handle our own emotions because of the sexism and racism we experienced from those same men. And it took all our strength to do so. It was not our job to handle their feelings, too. They would have to handle their own feelings.

I explained that we agreed to help our bar association and our state courts correct that sexism and racism which had made our justice system so oppressive to women and African-Americans. The least the men could do was handle their own feelings, responses and actions.the room grew so quiet one could have heard a pin drop. The men paled, and shrugged helplessly. They had no clue how offensive their comments had been. They were gentlemen and I was …. not.

This belief that the oppressed are expected to ” tread lightly” so as to ” protect men’s feelings” is exactly was the police ask if those protesting the police brutality that hides behind the Blue Line. That is not our job. The police who understand better than any the effects of police brutality need to handle their own feelings and their own actions. And those who stand up and advise us to not make them ” uncomfortable” ask too much.

End the 400 Years Long War in America

As a small child, I asked my Dad who served in WWII why soldiers called the Japanese “Japs” and worse names; and he explained: it is hard to kill another person, almost impossible to take human life. So soldiers use derogatory names which denigrate opposing soldiers to non-human status. Only after depriving the opposite side of their humanity can you kill them.

I noticed this during the Vietnam-Nam war when we used “ gooks ”. During the Iraq war, we used “towel heads” etc.

This is also what we did to justify slavery, using a word I can never utter, but so ingrained I do not need to tell you what it is. It is the same word we use to justify police brutality and murder of our fellow citizens. It is the word we use to justify our taking of Black lives ability to survive and thrive from cradle to grave post-slavery.

We may not use the word aloud but it has become part of our lexicon.

Some wars go on for hundreds of years. Some wars do not end by bringing home soldiers. But this war must end now. We must “bring back” law enforcement. To a place it has never been.

Instead, it has returned to the slave era of trackers searching out and punishing runners.

Instead we have a president, Vice-President, Attorney General and much of our populace, including police unions who have militarized our law enforcement. Instead, they militarize common citizens and encourage private militias armed for war.

It is no coincidence that we have allowed this to happen. Defund the militarization of law enforcement. Stop the militarization of private militias. End the war.

Used to be the Ku Klux Klan, men…even women… of every education level and background including law enforcement, donned white robes and hoods to protect their identity and hide their shame. Their stated purpose was to meet out justice to African-Americans who had crossed over a boundary; and,in some way failed to acknowledge the superiority and power of the white community.  Perhaps, a 14 year old African-American boy smiled at a white married woman as he entered her small grocery http://www.pbs.org/wgbh/amex/till/ . Perhaps a 37 year old African-American father of three children spent his days registering voters and seeking the end of Jim Crow laws as a  N.A.A.C.P field organizer http://www.history.com/news/7-things-you-should-know-about-medgar-evers.

 

The murders of Emmet Till and Medgar Evers are well known, but every African-American, boys and men in particular, endure retaliatory acts based on racial bias and racial animus every day. They are familiar with expressions of bigotry and punishment justified by white fear. The white robes are gone now,replaced by an unreasonable white fear instututionalized in the law, and unquestioned by the white media.

 

Attorneys on each side of the George Zimmerman murder trial scrupulously avoided the racial motivation for the murder. The judge ordered the phrase “racial profiling” not be used. White “legal experts” on every channel affirmed this approach, as that required by a unbiased court. They are all wrong. The only way the court could have been free of bias would have been to acknowledge the racial bias underlying the case.  Lady Justice is blindfolded but she is not stupid. She must not pretend race is not a motivation to kill. Our history clearly tells us otherwise. She need not play the fool; unless, she fears her power and authority can be used to empower scary African-American boys and men.

 

I expected the defense team to provide a strong defense woven into a story of why it was reasonable for a fully-grown man,trained in martial arts and armed with a gun, to fear a 17 year old African-American boy on his way home from a “munchies-run”. I expected the defense team to discount the boy’s right to defend himself from the attack his cultural history and his phone friend warned him to expect from his silent stalker. And,I expected the defense team to turn Trayvon’s self-defense into the justification of Zimmerman’s fear.

 

I naively did not expect the prosecution team to ignore racial bias.  Special Prosecutor Angela Corey stated “This case has never been about race or the right to bear arms. We believe this case all along was about boundaries, and George Zimmerman exceeded those boundaries.”  http://www.csmonitor.com/USA/Justice/2013/0714/Zimmerman-not-guilty-Victory-for-new-kind-of-civil-rights-era The prosecution was eager to talk about boundaries,a euphemism for racial animus. But of course, we refuse to admit the existence of racial bigotry. We refuse even when we are charged to seek justice for the murder of an African-American teenager who did NOTHING wrong;certainly,nothing to explain the irrational or unreasonable fear proclaimed by Zimmerman’s attorneys. The prosecution failed to admit race drove motivation until the last minutes of the trial. It allowed the defense to hide race under the hood,as many of us do when we face racial animus. What we fear is not African-Americans.What we fear is our own racism.

 

Now, the “legal experts” are proclaiming it is impossible to prove racial animus led to Trayvon’s death. The only reason they make this claim is beacuse they cannot comprehend, or refuse to acknowledge, the continuing and historical irrationality of white fear. No one who is willing to admit this “fear turned to hate” is hogwash believes the DOJ cannot find such a connection. On THE VIEW today,the “legal expert” Dan Abrams responded to factually-based questions and comments by Whoopi Goldberg and Sherri Shepherd by dismissing their comments as “emotional’. While they clearly felt emotional, their comments were no less rational this his own. In fact, they were more so http://abc.go.com/shows/the-view/blogs/hot-topics/george-zimmerman-verdict.

 

The lack of racial intelligence among our legal experts, prosecutors,defense attorneys,judges, media pundits and manyof us white Americans is institutionalized. This must change. twe must do all we can to raise our racial I.Q. We no longer wear physical hoods over our heads to hide our identity and our shame. We wear figurative hoods of ignorance over our heads to pretend we have no reason to feel shame. Take off the hoods,America! We cannot change what we refuse to face…our selves.

On September 11, 2012 4 Americans in the diplomatic service of the United States, at one of the most dangerous postings in the Middle East were murdered in Benghazi, Libya.

During the first 2 weeks of September 2012, 32 Americans were killed in Detroit; one of them and Iraq Vet and father of five children named Davis Nelson, who pushed aside a woman neighbor about to be shot by her husband in a domestic dispute and took the bullet himself. By the time of the Benghazi murders,Chicago had already seen 400 Americans murdered within its borders during 2012. During August 2012 alone, 38 persons were killed.( http://www.huffingtonpost.com/2012/10/01/chicago-homicides-reach-4_n_1929015.html ).

In Columbus,Ohio 83 Americans had been murdered between January 1 and  November 29, 2012.  The breakdown: 88% male, 70.7% African-American, 56.5% age 20-39, 79.3% shooting victims. ( http://www.dispatch.com/content/pages/data/crime-safety/homicide/homicides.html ).

During the past year, more than a 1,000 children died before their first birthdays in Ohio. The breakdown: 6.3% white, 5.7% Latino, and 15.8% African-American; likely the highest in the nation for African-American babies. More than 1 in 5 of all American children live in poverty; 1 in 3 American children of color live in poverty. As a result, America loses half a trillion dollars per year in lost productivity, increased health care costs, and increased crime. Excuse me for finding American’s obsessive concern about fiscal cliffs and the terrorist attack in Benghazi nothing short of ridiculous. Many Americans live on the fiscal cliff, just over its edge struggling to hang on, or at the bottom of the cliff all of their lives. Many Americans face the threat of violence and death daily in American cities and towns. The silence has been deafening in addressing these issues. It is not that Americans have been unaware of the problem; but, their solution has been to flee to suburbs and gated communities rather than addressing the needs of fellow Americans they identify as “the other”.

Rep. John Boehner (R-OH) and others warn us that we must protect the low tax rate of the richest of the rich and their investments. To do so he insists we cut  redefined entitlements. Entitlements are those things to which one is entitled; over which one has ownership rights. These same small-government proponents propose taking away our property rights, our entitlement to the Social Security and Medicare benefits we paid for through payroll deductions from every paycheck we have ever earned by reason of our labor. They have redefined entitlements as gifts from our socialist president, and socialist Democratic party. Please, spare us the hypocrisy. You spare us very little else.

And John McCain reminds us daily that 4 Americans died in Ben Gahzi. Mr. Cain, where is your outrage over the Americans killed by violence in the hearts of our cities every night? Over the infant mortality rate for our babies? Over the 3532 American Iraq War dead? Which you supported despite the obvious lies used to justify it. Forgive me if I find your outrageous disdain for Ambassador Rice the farce it is.

It has been difficult for me to write because it has been difficult to channel my anger toward those who continue to obstruct the people’s business in Congress, who continue to filter their world view through a racist and sexist lens, who believe they lost the 2012 election simply because they mistakenly and incompetently marketed their party platform to the public, and who only regret the failure, but not the use, of their voter suppression efforts.

I admire President Obama’s ability to tolerate such hypocrisy and continue to seek workable agreements with persons whose words twist reality, whose motives cannot be trusted, and whose sexist and racist world view is potentially harmful to so many Americans. We must demand  that President Obama, Rep.Nancy Pelosi (D-CA), Rep. James Clyburn (D-SC)and Sen.Harry Reid(D-NEV) ask more of their Republican colleagues, not less, in their negotiations. At the very least they must demand respect for people of color and women (including Ambassador Rice), adherence to truth, and a firm commitment to openly support any agreements they reach.

I grieve the loss of life in Ben Ghazi, and continued threats to those Americans who represent our country abroad. But, I also grieve the the daily threats to America’s children and families who face on-going threats of economic loss and violence, especially within the African-American community. Where is our outrage on their behalf? Who will speak for these Americans? Will you?

If we are to believe the media-take on the re-election of President Barack Obama, we managed to have our votes counted; but, we still don’t count. Despite the fact that Barack Obama won by a greater margin than George W. Bush without the need for court intervention to seal the deal, corporate media refuses to acknowledge president Obama’s mandate. Instead it sees his presidency as one calling for accession to the demands of those whose candidate lost the election and the majority of the electorate’s support for Republican policies.

 

The list denying a mandate includes: CBS Evening News’ Bob Schiefer. Washington Post’s Dan Balz. Politico’s Glenn Thrush,Jim VandeHei,and Mike Allen. CNN’s David Gergen, and Gloria Berger. FOX News’ Charles Krauthammer.Time Magazine’s Joe Klein.

 

Even NPR’s Cokie Roberts failed to credit the value of those who voted for the President and handed him a mandate when she described his challenge to govern in this way: “It is a divide where he’s lost whites, he’s lost Southerners, he’s lost people of a certain income and age, and he’s really got to do something fast to deal with that.”

 

Oh, I see now whose vote REALLY counts: whites (but not those whites who voted for Obama), Southerners (but not those Southerners who voted for Obama), people of a certain income and age( but not those wealthy, older persons who voted for Obama). Interestingly, the need to address the concerns of African-Americans, Latinos, Asians, young people, women and LGBT community seems to be of no concern to Ms. Roberts. Apparently, she thinks she knows who should be driving the bus, and who should ride in the back.

 

It is not because she sees division as a concern which disturbs me; we are all concerned about the divisions within our country. But, because she weighs the interests of those who do not support Obama as a greater issue for his attention than the mandate the majority of voters handed him on November 6 to enact the change we need to secure America’s future for all its citizens. It is the diminished value corporate media places on an Obama victory for those who do not look like them, earn what they earn, live like they live. By diminishing his win, they diminish his right to govern and they diminish the value of our vote. That diminishes all Americans.

Now the counting of provisional ballots in Ohio shifts to the Republican theme that 47% of us refuse to accept responsibility for ourselves. On Friday Ohio Secretary of State Jon Husted added reasons to reject a provisional ballot with incorrect or missing information as to the type of Identification used by voters casting a provisional ballot, SHIFTING RESPONSIBILITY for checking the appropriate boxes on the provisional ballot affirmation form from poll workers to voters.

Husted spokesman Matt McClellan said the provisional ballot affirmation form  (above) is the same that’s been used in this year’s spring primary and a special election in August. This is NOT the point. What matters is that it is contrary to Ohio law and violates court decree.

Ohio Rev. Code § 3505.181(B)(6) provides that, once a voter casting a provisional ballot proffers identification,  “the appropriate local election official shall record the type of identification provided, the social security number information, the fact that the affirmation was executed, or the fact that the individual declined to execute such an affirmation and include that information with the transmission of the ballot . ..”

This is an overt effort by Ohio Republicans to avoid a previously entered court decree as described by plaintiffs in Case: 2:06-cv-00896-ALM-TPK Doc #: 346 Filed: 11/01/12 Page: 1 of 11 PAGEID #: 12588. In the earlier decision and consent decree filed before US District Court Judge Algernon Marbley, it was agreed by all parties, including Republican SOS Husted, that he direct Ohio’s 88 county election boards to count certain provisional ballots WHERE POLL WORKERS MADE MISTAKES such as: 1. Allowing or directing voter to cast ballot in the wrong precinct, but correct poll location. 2. Allowing voter to cast ballot without completing or signing the ballot. 3. Failing to complete the application for the voter,as required by Ohio law.

As a former poll workerI can attest that it is not uncommon to overlook a missing piece of information when polls are busy; but,it is the poll worker’s duty to assure each voter’s ballot will be counted by correctly completing information requested on the ballot envelope. Poll workers,not voters, are trained to understand the language on the provisional ballot envelopes and trained to assure the form is complete. Voters do not second-guess poll workers;but, simply follow the directions to the best of their ability. They rely on the competence of poll workers. Plaintiffs’ counsel Subodh Chandra explains, “Judge Marbley’s decision ensures that legitimate voters do not  lose their right to vote when government workers make mistakes.”

SOS Husted is attempting to make sure such ballots are not counted,despite his prior consent to Judege Marbley’s decree by throwing sand in our face and making the issue VOTER IRRESPONSIBILITY, rather than poll worker error. Disrespect for the constitutional rights of voters to cast a ballot which will be counted is just the latest effort to undermine the Ohio election by confusing Ohio voters, and stealing their votes.

Our solution is simple: GET OUT THE VOTE. A huge turnout is the only way to assure a clean decision on election night, rather than an election dragged through the courts ad infinitum. BUT BE WARNED: Even if we elect President Obama on election night by overpowering Republican vote theft with an exceptionally high turnout, Republicans will use continued court involvement as a sign that President Obama is NOT REALLY the winner. Al Gore backed away from such an argument to  preserve our union and uphold the election process. I doubt Ohio Republicans will behave with such respect. They have not for the past four years;so don’t expect a sudden change of heart.
